Medical Malpractice Terms and Definitions

 

 

Acute Pain
Pain that has a known cause and occurs for a limited time. Acute pain usually responds to treatment with analgesic medications and treatment of the cause of the pain.

Noneconomic damages
Damages payable for items other than monetary losses, such as pain and suffering. The term technically includes punitive damages, but those are typically discussed separately.

Arbitration panels
Many states have formed arbitration panels in order to resolve disputes between doctors and their patients.

Res ipsa loquitur
The use of res ipsa loquitur should be prohibited in medical malpractice cases because under this doctrine the mere fact that the injury occurs means that the defendant was negligent, although it is not all the time.

Discovery
The pre-trial process, such as a deposition, by which one party discovers the evidence that will be relied upon at trial by the opposing party.

Board-certified specialist
A physician who has successfully completed an ACGME-approved residency program or its equivalent in an American Board of Medical Specialties (ABMS)-recognized specialty and has been certified by an ABMS member board

Affidavit
A voluntary statement or declaration of facts that has been written down and confirmed under oath.

Medical Practice Act
A statute of a US state or jurisdiction that outlines the scope of practice for physicians and the responsibility of the medical board to regulate that practice. The primary responsibility and obligation of a state medical board is to protect the public through proper licensing and regulation of physicians and, in some jurisdictions, other health care professionals.

Obstetrics
Prenatal care requires collecting, tracking and analyzing a complex series of clinical data collected over several prenatal visits.

Medications Malpractice
This category covers claims arising from inaccurate medication prescriptions, such as wrong medication or dosage level.
